TERMS & CONDITIONS

 

CHARRRGE LTD is a company incorporated in England (company number 13860442 with its registered office at 9-13 Thorne Road, Doncaster DN1 2HJ. 

Definitions 

In this document the following words shall have the following meanings: 

  • CUSTOMER means any individual, partnership, limited company, charity or organisation that from time to time purchases Services from the Supplier 
  • SUPPLIER means Charrrge Limited 
  • PROPOSAL means a statement of work, quotation or other similar document describing the services to be provided by the Supplier 
  • SERVICES means the services specified in the proposal 
  • FEES shall mean all charges and expenses that will be invoiced by the Supplier to the customer for the services provided 
  • TERMS AND CONDITIONS means the terms and conditions of supply set out in this document and any special terms and conditions agreed in writing by the Supplier.

1.Our Commitment

To provide a hassle free EV installation experience. Our team have vast knowledge about the products available to purchase, we can guide you on your installation options and even fulfil groundworks should this be required prior to the installation appointment. We are committed to providing a professional service with competent engineers and thorough customer care. Charrrge Ltd is regulated and adheres to guidelines set by NICIEC and OZEV.

The Service:

  • The service proposal and subsequent quote specific to the survey information shall remain valid for a period of 30 days. A time extension of the original quote is at the discretion of Management. 
  • The Customer shall be deemed to have accepted the service proposal by placing an order with the supplier and providing a deposit/payment for the services outlined in the proposal, survey and quote documentation issued by Charrrge.co.uk on behalf of Charrrge Ltd. 
  • Charrrge Ltd will not commence work until the customer has accepted these Terms and Conditions as well as the instructions including, but not limited to, the contents of the terms and conditions 
  • The Supplier shall not be liable for failure to complete the work within the proposed timeline. Financial compensation will not be provided for events beyond Charrrge Ltd control, such as, stock shortages or delays, cancelled appointments due to absence/illness of engineer, or Network provider delays.
  1. Scope of Work

The details of the work required to complete a successful installation is completed at the initial assessment. Surveys are completed to suit the needs of the customer and the company, for example, the company is able to provide the survey service in person, via video link or by the use of photographs provided by the customer. Complex installations, referred to as non-standard installations, may require an in person survey from one or more engineer/representative of Charrrge Ltd. 

Standard installation: 

  • The fitting of the EV Charge Point shall be on a brick or plaster wall (or other suitable permanent structure). 
  • Routing of the cable through 1 x drilled hole in a wall up to 500mm thick (where required). 
  • Up to 15 metres of High Tuff cable, run and clipped to the wall between the consumer unit and the EV charger, up to a height of up to 1.8m. 
  • All necessary electrical connections to be made from the origin of the supply to the Electric Vehicle Charging Unit. 
  • The installation of a Type A RCBO in the consumer unit. 
  • The supply of up to 3 metres of plastic conduit or trunking to conceal interior wiring. 
  • The supply of all necessary Electrical testing and NICEIC Certification. 
  • Demonstration of the Charge point functions and App to the customer. 
  • No requirement to work at height (i.e over 1.8m) 

Non-Standard Installation: If in the event that the installation is non-standard and additional works are required which Charrrge Ltd agree to be outside the scope of a standard installation, Charrrge Ltd will provide a description of the additional work with a quotation which is in line with our standard pricing list. If you agree to proceed with the proposed/revised installation plan, the additional work performed will be invoiced to you by Charrrge Ltd 

Timing: Charrrge Ltd will strive to make an appointment with a Charrrge.co.uk engineer within 14 days. In the event that this is not possible, the customer will be provided with the next available appointment. No financial compensation will be provided to the customer in the event that an appointment cannot be obtained within 14 days. The installation appointment can take 2-4 hours. For a non standard installation the timeframe will be dictated by the volume of work however our team will provide you with an estimate prior to the appointment.

  1. Your Commitment

The commencement of work leading up to and including the installation will only be fulfilled when the required deposit has been made and acknowledged by the supplier. The customer agrees that during the installation, the remaining balance will be paid immediately to the supplier. The customer understands that failure to comply with this condition could result in the termination of services and loss of the total deposit paid by the customer. In this event the customer could be liable for further charges. The customer is to ensure that the planned work can be completed without distraction or obstruction. The customer understands that their presence at the property is necessary to the completion of the installation unless required. Failure to be present for the allocated appointment could result in a fee of £75.00 and an additional appointment will be arranged. Charrrge Ltd will strive to provide a timeframe in which the engineer will arrive. This timeframe would not exceed a 2 hour window. Although this is our intention this may alter with unforeseen events such as traffic or delays at a previous installation. We will do what we can to ensure that you are contacted and informed of such delays. During the installation process the electricity supply will need to be shut off for a period of time in order for the engineer to work safely. The customer should consider this factor if working from home. Our team will work as quickly as possible to ensure little disruption as possible. The customer will ensure that the working area is clear and safe for work to commence as planned. This includes, but is not limited to, removing personal items for the full length of the cable run. Charrrge Ltd cannot be liable for personal property that is damaged during an installation. Should an installation not be completed due to obstruction or incorrect information such as a longer cable length is required, Charrrge Ltd are acting reasonably by imposing cancellation fee for the failed appointment. This fee will be payable on the day and amounts to £75.00 per failed/incomplete appointment. If the appointment is not complete due to the failures of Charrrge Ltd, an appointment will be made at the earliest convenience of both the engineering team and the customer. In the instance that unexpected/additional works are required in order to complete the appointment, Charrrge Ltd will provide a new invoice detailing the costs for such work. You agree that any monies owed to Charrrge Ltd will be made within a reasonable timeframe and/or before the work begins. Charrrge Ltd reserve the right to refuse to start work without payment for services

  1. The Power Network

The rate your charger is capable of charging at is ultimately determined by local power network conditions. The Network provider (known as DNO) states how much power is available at the location where it is installed. The DNO conditions vary due to the local electrical load and also as a result of local generation. If, at any time, there is not enough power available to charge at the maximum rate your charger is capable of, it may be temporarily restricted to a lower charging rate until the local conditions improve. Local power network conditions are not under Charrrge Ltd’s control and therefore Charrrge Ltd does not guarantee any particular power output, additional work liability or availability period in relation to your charger point. Charrrge Ltd accepts no liability or responsibility for issues such as performance arising therefrom or additional costs that may be incurred for upgraded systems

  1. Additional Services

Charrrge Ltd services include groundworks within both residential and commercial settings. A survey is required ahead of the works beginning and a quote would be provided prior to any commitment from the customer or Charrrge Limited. The quote provided will state an overall cost of service, supply of labour and materials. The quotation will be an accurate representation of the work that is required and completed by our experienced team. It is not possible to divide the quotation for example, the customer sourcing the materials or supplying workmanship. Should the quote not be accepted, the customer would be invited to source an alternative quote from an alternative supplier. Groundworks carried out by the customer or a third party hired by the customer must meet the safety guidelines detailed in the job description. Proof of the groundworks would need to be provided ahead of the installation date and an assessment of compliance will be performed by the relevant division before the electrical engineer arrives at site to fulfil the installation of the chosen charge point In the event that the groundworks have not been completed or so not meet regulatory compliance standards the appointment to install the charge point will not go ahead. In the event that the engineer has arrived at site, and work cannot be completed, the customer may be liable for the failure of the appointment and a fee of £75.00 would be charged. An additional appointment would be made at the earliest opportunity and within a 2 week window. The customer understands and accepts that unintentional damages are possible taking into account the durability of the materials that are being temporarily removed or relocated. Charrrge Ltd are not liable for the costs of replacing or compensating customers for minor damages. Charrrge Ltd team members will notify the customer of any concerns prior to the commencement of work and the instruction of the customer will be documented on our account. Upon completion the customer will be asked to sign a satisfaction notice. 

Charrrge Limited cannot provide services additional to the installation that are the direct responsibility of the DNO or Energy Provider, This includes but is not limited to fusebox upgrades, tail upgrades and the fitting of isolator switches. Energy saving devices that are compatible or can be linked with the EV charger are also not included in the services we provide. The supplier takes no responsibility for additional purchases made by the customer and accepts no liability for additional services required after the charge point has been installed.

  1. Product and Workmanship Warranties

The warranty of the product varies and is dictated by the manufacturer of the Charge point. Product warranty varies between 2-5 years however the details of the warranty can be located in the paperwork provided by Charrrge.co.uk and within the product user manual. In the event the information cannot be located, the customer can contact the Charrrge.co.uk Support Team by emailing a written request. This request should be sent to hello@charrrge.co.uk Charrrge.co.uk agrees to provide the customer 1 year (12 months) from the date of initial installation, workmanship warranty. Should a fault occur, the customer should contact our customer care team. An engineer will aim to attend the property within 5 working days of the fault notification. This appointment is free of charge if it is deemed that there is a fault with the unit that is beyond the control of the customer. Such warranty is void in the instance that the unit has been damaged since the initial installation. This includes but is not limited to: Impact to the casing/charge point unit, removal of the safety equipment/outer casing, interference from another electrician/workman, opened packaging prior to the installation. Charrrge Ltd will record the installation process and retain the information for the duration of the warranty to assist with diagnosis in the eventuality that the unit suffers a fault. This information will be used to cross reference the information collected at the service call and may be shared with the manufacturer if requested

  1. Ownership

Charrrge Ltd shall retain ownership of the product ordered by the customer along with assisting documentation, until the completion and presentation of electrical certificates. The customer may be responsible for receiving the product directly from the manufacturer on behalf of Charrrge Ltd. In the event of a cancellation before the installation appointment, Charrrge Ltd will retrieve the unit which must remain unopened within its original packaging. Costs to retrieve the item in the event of a cancellation may result in a fee payable by the customer.

  1. Use of Personal Data

Charrrge Ltd is the key controller and holder of data provided by the customer. Data is collected from various methods such as marketing campaigns, customer feedback, customer enquiries and consumer trends. The data is produced to improve the services we provide. Our processes ensure that all data is stored and used to comply with laws and regulations. We may use your data to prevent and detect crime, such as fraud. Third Party / Data Sharing: Information regarding your installation may be shared with a third party working on behalf of Charrrge Ltd Our installer network is made of highly qualified individuals who may contract their services to our company. Subcontractors have limited access to the company data system however they can access the ‘scope of work’ information that has been specifically allocated by Charrrge Ltd. This allows us to ensure that full planning has been fulfilled prior to the installation appointment. All other data such as payment confirmation, communications between the customer and Charrrge.co.uk is all contained in a system that is unavailable to our subcontractor network. Our data storage systems are compliant under the General Data Protection regulations. 

 

Your Rights: You have the right to object to some of the processing performed by Charrrge Ltd. Requests to amend, view or erase your data must be submitted in writing to hello@charrrge.co.uk An identity check will be carried out as part of our compliance procedures. 

 

Data Retention: We keep your data to enable us to fulfil our contractual obligations to you whilst you remain an ‘active customer’. Charrrge Ltd will retain data for the minimum time required as dictated by Data Protection regulations or in accordance with warranty guidelines. We may keep your data for longer if we cannot erase it for legal, regulatory or technical reasons

  1. Cancellation and Refunds

The customer may cancel the Service by notifying the Supplier in writing at the address above giving 7 days’ notice. Written notice should be provided to hello@charrrge.co.uk All work undertaken up to receiving cancellation must be paid for within the notice period, this includes but is not limited to groundworks, electrical works or partial installation. The supplier may, at the customer’s expense, charge any costs relating to the winding up of any work being carried out as part of the contract including, but not limited to fees, court or tribunal costs or any other reasonable third party liabilities.

  1. Force Majeure

Neither party shall be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the party shall be entitled to a reasonable extension of its obligations.

  1. Limitation of Liability

The Supplier undertakes to maintain Public Liability Insurance limited to £5,000,000 for each and every occurrence and Professional Indemnity Insurance limited to £5,000,000 in total. The Supplier will maintain Employer’s Liability Insurance cover at the appropriate level. Nothing in these Terms and Conditions shall exclude or limit the liability of the Supplier for death or personal injury. However the Supplier shall not be liable for any direct loss or damage suffered by the Customer however caused, as a result of any delay in the work carried out, negligence, breach of contract or otherwise in excess of the price of the Service. Charrrge Ltd will not be held responsible for third party costs incurred by the customer for any reason whatsoever. Charrrge Ltd qualifies its subcontracted staff who provide their own liability insurance. This documentation is retained by the company and reviewed upon renewal on an annual basis.

  1. Complaints procedure

Charrrge Ltd Limited will always aim to deliver excellence however there may be times when this level of service has not been achieved. Charrrge Ltd has a complaints procedure to allow the customer to provide us with valued feedback or events/issues that have arisen. The customer should provide a written account and send it to hello@charrrge.co,uk. This inbox is monitored and the complaint will be escalated to the appropriate Line Manager. An initial acknowledgement will be received and the team aim to respond within 3 working days. A thorough investigation will be launched if required and the customer will be notified if more time is required for this work to be concluded. If there is a dispute about the interpretation or operation of this contract then the supplier will make every effort to resolve the dispute when and where it arises, negotiating on the basis of good faith
